Associate
Kendall C. Fisher-Wu is a Labor and Employment law associate at Boutin Jones, where she represents employers in single-plaintiff matters, wage and hour class actions, and PAGA claims. She is well-versed in all phases of litigation through trial, including written discovery and discovery motions, taking and defending depositions, and handling dispositive motions. Kendall has participated in and handled numerous mediations on all types of employment cases. Kendall has expertise in working with clients across diverse industries, including the foodservice industry, grocery stores, retail, healthcare, and mining companies governed by the federal Mine Safety and Health Administration (MSHA).
Kendall is experienced in conducting workplace investigations and is a certificate holder with the Association of Workplace Investigators (AWI-CH). She also develops and presents client trainings on harassment prevention and best practices in workplace investigations. Kendall advises employers on day-to-day employment issues and data privacy compliance, including data privacy matters involving the California Consumer Privacy Act and California Privacy Rights Act.
She earned her J.D. with Great Distinction and Order of the Coif honors from the University of the Pacific, McGeorge School of Law, where she graduated second in her class. While at McGeorge, Kendall was the Editor-in-Chief of the McGeorge Law Review and received the Witkin Award for earning the highest grade in the class in seven courses, including Property, Constitutional Law, and the school’s legal research and writing course.
Kendall is dedicated to giving back to the community through pro bono legal work. She has participated in immigration clinics for Afghan refugees in the Sacramento area and pro bono clinics for pro se litigants in federal court, and handled multiple asylum cases on a pro bono basis.
“Before law school, I worked at a corporate coffee shop for over three years as a barista and a supervisor. This experience helps me relate to my clients’ employees and understand the nuances of their day-to-day work.”
When I’m not working, I love to spend time with my family (i.e. chase around my young kids), drink coffee, and go to Costco. My husband and I’s favorite food is sushi—even though I’m a lifelong vegetarian, I love a good veggie roll!
Experience
Secured a complete grant of summary judgment in federal court on an employment disability discrimination case; affirmed by the Ninth Circuit.
Achieved dismissal of multiple employment discrimination and harassment claims for nuisance value.
Handled numerous complex and highly charged workplace investigations, including a multifaceted investigation of a government counsel office and a contentious investigation of a police department.
Filed a successful writ of habeas corpus for an individual who had been detained by ICE without a bond hearing; briefed and argued the bond hearing and secured client’s release on minimum bond.
